Divorce

Navigating a marriage dissolution requires decisive legal guidance, financial clarity, and an advocate who understands the local court system. If you are preparing to file in Stockton or anywhere in San Joaquin County, here is how the California divorce process unfolds—and how Maples Family Law protects your interests.

To file in San Joaquin County, at least one spouse must have resided in California for the prior six months, and in San Joaquin County for the prior three months (California Family Code § 2320).

The dissolution begins by submitting initial pleadings to the San Joaquin County Superior Court (Family Law Division in Stockton).

Your spouse must be formally served with court documents by a neutral third party or a registered process server.

Once served, the responding spouse has 30 calendar days to file their response.

If immediate stability is required regarding child custody, spousal support, child support, or exclusive use of the family home, temporary orders can be filed immediately.

Both parties must fully disclose all separate and community property, income, debts, and assets under penalty of perjury.
